Question

Salam Alaikum Mufti sahib,

I have been married for a few years and although married life is good my husband says really bad things sometimes in a joke

Like for example, he says "I am Jewish" then says astaghfirullah I was just joking. So many more examples which I don't want to give, some really bad ones such as saying "You are Allah" and then straight away he says astaghfirullah and he laughs and jokes with things like that. I think maybe something is wrong in his head. He also says he has divorced me then he says I'm joking I haven't and he finds it funny like nothing happened.

But would that affect my marriage in any way?

Answer

If someone says “I am a Christian”, whether he said it in jest or seriously, he will become a kafir. Even if a person says “so and so religion is better than Islam”, he will become a kafir. (Apka masail awr un ka hal,  pg.46,  vol. 2,  maktabah ludhyanawi.)

Based upon the above quote, if a person says “I am a Jew”, he will leave the fold of Islam, therefore he has to renew his Islam by reading the shahadah, and also he needs to renew the nikah.

If a person divorces his wife in jest, divorce will still take place. 

Abu Hurairah (R.A) narrates, The Prophet () said: There are three things which, whether undertaken seriously or in jest, are treated as serious: Marriage, divorce and taking back a wife (after a divorce which is not final) Abu Dawud, pg. 516,  vol. 3,  hadith no. 2194, Darul risalah al alamiyah.
