We have a house in the wife&#8217;s name and she wants to transfer it to her son&#8217;s name. The value of the property is around 80 million Pak Rupees. Does he have to pay 20 million to me (being owner\u2019s husband), 20 million to his sister, and property can be his? (We deduced this from laws of inheritance).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong><u>In the name of Allah, the Most Gracious, the Most Merciful<\/u><\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong><u>Answer:<\/u><\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">The distribution of wealth to children should be given equal, whether the children are male or female.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">During one\u2019s lifetime, one will not distribute wealth among one\u2019s children according to the laws of inheritance but will give them equally, irrespective of male or female. This is not considered inheritance as the giver is still alive and instead this will be regarded as a gift. Gifts should be given equally amongst children and not in accordance with the laws of inheritance as they are two separate issues.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">It is of paramount importance to understand the difference between a bequest (wasiyyah) and a transfer of wealth (hadiya or \u2018atiyya).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">A bequest is where a person says, \u201cUpon my death, give such and such amount to so and so. Once the person has passed away, there is a calculation to ensure that no debts are owed, that the total bequests do not exceed one-third of the deceased person\u2019s total wealth, and then to see if that person is a suitable recipient.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">One of the matters that would cause a person to not be able to receive a bequest is if they are an inheritor, such as a spouse or child as The Messenger (\u0635\u0644\u0649 \u0627\u0644\u0644\u0647 \u0639\u0644\u064a\u0647 \u0648\u0633\u0644\u0645) said;<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">\u0625\u0646\u0651\u064e \u0627\u0644\u0644\u0651\u064e\u0647\u064e \u062a\u064e\u0628\u0627\u0631\u064e\u0643\u064e \u0648\u062a\u064e\u0639\u0627\u0644\u0649 \u0642\u064e\u062f\u0652 \u0623\u0639\u0652\u0637\u0649 \u0644\u0650\u0643\u064f\u0644\u0651\u0650 \u0630\u0650\u064a \u062d\u064e\u0642\u0651\u064d \u062d\u064e\u0642\u0651\u064e\u0647\u064f\u060c \u0641\u064e\u0644\u0627\u064e \u0648\u0635\u0650\u064a\u0651\u064e\u0629\u064e \u0644\u0650\u0648\u0627\u0631\u0650\u062b\u064d<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">&#8216;Indeed Allah, Most Blessed and Most High, has given the right due to everyone deserving a right. So there is no bequest to an inheritor\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Hence, if a person is guaranteed a portion of the inheritance, such as a son or a daughter, then they would not be able to receive a bequest.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">A bequest is the transfer of wealth after the death of a person and it comes from their estate.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">When a person is alive and not on their deathbed, then they are free to give away any portion of their wealth to whoever they would like.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Once a person is on their deathbed, they are no longer allowed to give away their wealth since that is similar to giving away the right of the inheritors.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">So, if a person\u2019s parents are not on their death bed, they can give their wealth to one child over the other or more to one than another, although it would be Sunnah for them to be equal in their distribution of wealth as the Messenger of Allah (peace and blessings be upon him) said,<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">\u0642\u0627\u0631\u0650\u0628\u064f\u0648\u0627 \u0628\u064e\u064a\u0652\u0646\u064e \u0623\u0648\u0652\u0644\u0627\u062f\u0650\u0643\u064f\u0645\u0652<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">\u201cTreat your children equally\u201d.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;
