{"id":21601,"date":"2022-01-13T20:50:57","date_gmt":"2022-01-13T20:50:57","guid":{"rendered":"http:\/\/daruliftabirmingham.co.uk\/?p=21601"},"modified":"2022-01-13T20:50:57","modified_gmt":"2022-01-13T20:50:57","slug":"three-talaqs-via-whatsapp","status":"publish","type":"post","link":"http:\/\/daruliftabirmingham.co.uk\/home\/three-talaqs-via-whatsapp\/","title":{"rendered":"Three Talaqs via WhatsApp"},"content":{"rendered":"<p style=\"text-align: right;\"><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong>Fatwa ID: 05752<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong>Answered by: Mufti Eunus Ali<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong><u>Question<\/u><\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">If the following messages are sent via WhatsApp to the wife then are they 3 divorces also the husband had the intention to scare and worry his wife when he said he didn&#8217;t actually want a divorce :<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">I\u00a0divorce<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">I divor<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">I\u00a0divorce\u00a0you<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Are these 3 divorces?<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong>In the name of Allah, the Most Gracious, the Most Merciful<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\"><strong>Answer:<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Firstly it is narrated by AbuHurayrah (may Allah be pleased with him):<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">The Prophet (\ufdfa) said: There are three things which, whether undertaken seriously or as a joke, are treated as serious: Marriage, divorce and taking back a wife (after a divorce which is not final).<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">From the above Hadith, we learn that to issue or write a talaq to scare the wife will take effect regardless of the intention of the husband.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Secondly, the written divorce (whether it be by pen or as a text message) is divided into two categories:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Marsumah: is where the letter is addressed to his wife.<\/span><\/li>\n<li><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Ghair Marsumah is where the letter is not written to his wife.<\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Then Marsuma and GhairMarsumahhave both been further divided into two types:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Clear and explicit writing: the example of this is the writing that is done on a piece of paper, wall or ground in a manner that is understandable.<\/span><\/li>\n<li><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Unclear and implicit writing: the examples of unclear writing will be to write on the air, on water or on something in a way that is not understandable or legible.<\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">As for the first type whereby the writing is clear and it is directed or referred to his wife for example he says \u2018I have given you a divorce,\u2019 then a divorce will occur irrespective of the husband making an intention or not of the divorce.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">When the writing is unclear or eligible, divorce will not occur irrespective of it being Marsumah orGhairMarsumah. In this category, the intention will not be taken into consideration.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">Finally, when the writing is clear but it is not directed or written to his wife for example he typed the word \u2018divorce\u2019 or \u2018Talaq\u2019 then talaq will occur if he made an intention of it, otherwise no divorce will occur. <a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif; font-size: 12pt;\">In regards to your question, as the husband had used WhatsApp to message the wife, it will be considered marsumah.
