Assalawalekum, a few weeks before I saw a document from Darul Ifta answered by Maulana Dilwar Hussain that an oath<\/span>
\nmade mentally or by intention is needed to fulfil, how can it be possible I heard many scholars say that an oath is valid when is spoken orally. Please answer<\/span><\/p>\n

One of the methods in which an intention is made clear is to orate it (i.e., to say it aloud) just as you have stated. However, this is not a condition for its validity.<\/span><\/p>\n

 <\/p>\n

All\u0101h Ta\u2019\u0101l\u0101<\/em> says: \u201cDo not make (the name of) All\u0101h<\/em> an excuse against being righteous and fearing All\u0101h<\/em> and making peace among people. All\u0101h<\/em> is All-Hearing and All-Knowing. All\u0101h<\/em> does not impose blame upon you for what is unintentional in your oaths, but He imposes blame upon you for what your hearts have earned. And All\u0101h<\/em> is Forgiving and Forbearing.\u201d [S\u016brah al-Baqarah; 2:224-225<\/em>] [1]<\/span><\/p>\n

It seems as though you may be referring to a Nazr.<\/em><\/span><\/p>\n

When a Nazr<\/em><\/strong> is taken, it will be implemented whether it has been said<\/u><\/strong> with or without any conditions and whether or not any intentions were made with it at the time. For instance, giving Tal\u0101q<\/em>. Uttering Tal\u0101q<\/em> to one\u2019s wife will make it effectual, even if it was done in jest. [Radd ul-Muht\u0101r: vol. 5, pg. 516<\/em>] [2]<\/span><\/p>\n
