I and my partner were present and the mufti was on the phone but there was no witness. My parents are separated. I never ever concealed anything from my mother whether she would support me or not, I used to tell her everything even about the nikah and she permitted me of nikaah but she was not present at the time of the nikah, this all happened yesterday.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">Is it valid or not?\u00a0 Because the nikah is performed by the mufti on the phone without any witness and my mom wasn&#8217;t there.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">And I didn&#8217;t tell my mom about the nikaah yet. I&#8217;m also confused whether to call my mother about the nikah or not. Because I thought it is not valid without my mother&#8217;s presence.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: verdana, geneva, sans-serif;\"><u><strong>In the name of Allah, the Most Gracious, the Most Merciful<\/strong><\/u><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><u><strong>Answer:<\/strong><\/u><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">A condition of nikah being done is that there has to be a walee (guardian) and witnesses:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">Our beloved prophet (SAW) has mentioned:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">\u0644\u0627\u064e \u0646\u0650\u0643\u064e\u0627\u062d\u064e \u0625\u0650\u0644\u0627\u0651\u064e \u0628\u0650\u0648\u064e\u0644\u0650\u064a\u0651\u064d<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">There is no marriage without the permission of a guardian. [Tirmidhi Hadeeth no: 1102]<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">He (SAW) also mentioned in another Hadeeth regarding witnesses:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">\u0644\u0627 \u0646\u0643\u0627\u062d \u0625\u0644\u0627 \u0628\u0648\u0644\u064a \u0648\u0634\u0627\u0647\u062f\u064a\u0646 \u0645\u0646 \u0627\u0644\u0645\u0633\u0644\u0645\u064a\u0646<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">There is no marriage contract except with a walee and two witnesses. [Tabrani Hadeeth no: 7558\/Ibn Hibban Hadeeth no: 4075]<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">So as the nikah over the phone didn\u2019t have sufficient witnesses, the nikah is invalid. We should also remember the walee mentioned in the Hadeeth. Unless there is no such person or the relatives do not fit the requirements, closely linked relatives should not be disregarded. The walee of a lady is her father, followed by any successors her father may have named before his passing, and finally her paternal grandfather or great-grandfather. If not the Muslim leader \u2013 in this day and age if not found, a local Imam etc.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">In the future, if one is to do nikah over communication means, have the guardian present and also do it on Skype\/zoom etc. It would be clearer and removes all ambiguity.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">With regards to not telling your mother about it, that should be avoided (keeping it a secret from your mother).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">\u0623\u064e\u0639\u0652\u0644\u0650\u0646\u064f\u0648\u0627 \u0647\u064e\u0630\u064e\u0627 \u0627\u0644\u0646\u0651\u0650\u0643\u064e\u0627\u062d\u064e \u0648\u064e\u0627\u062c\u0652\u0639\u064e\u0644\u064f\u0648\u0647\u064f \u0641\u0650\u064a \u0627\u0644\u0652\u0645\u064e\u0633\u064e\u0627\u062c\u0650\u062f\u0650 \u0648\u064e\u0627\u0636\u0652\u0631\u0650\u0628\u064f\u0648\u0627 \u0639\u064e\u0644\u064e\u064a\u0652\u0647\u0650 \u0628\u0650\u0627\u0644\u062f\u0651\u064f\u0641\u064f\u0648\u0641\u0650<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\">Publicise the marriage, hold it in the Masjids, and beat the duff for it (to be done publicly).
