My mom provides day-care and we make a contract with parents, normally for a 1-year period but shorter if the parents request it. We take a deposit from parents to reserve a spot. Additionally, we use that money in case they don\u2019t pay us during a month the time we provide day-care. If they do provide the payment throughout their stay, then we use that deposit payment in their last month of care. Similar to when provide a deposit for a rental house\/apartment.<\/span><\/p>\n

We also wrote in our contract that if the parents leave before the contract finishes then the deposit is not refundable. We want to ask if in a situation a child starts day-care with us and does not stay until the end of the contract, Islamically are we allowed to keep the deposit? Or do we have to return it back.<\/span><\/p>\n<\/div>\n

With regards to deposits, it would only be permissible to keep an amount that would compensate for any harm that befell the seller due to the running away of the buyer midway through the term. If no harm was caused, then the amount should be refunded.1<\/sup><\/a> If the buyer ran away without paying for a month of service you provided, you may keep the deposit for that month and you are compensated. However, if they paid for everything up to that point and no further harm is coming to you by their departure, you must return the amount.2<\/sup><\/a><\/span><\/p>\n
