I had a kid in my previous marriage and he is not an adult. He is an orphan and living in Pakistan with my parents, they are old enough that they can\u2019t look after him and are now unable to fulfil his responsibilities because they can hardly take care of themselves. I am here in the UK and my husband is not willing to keep him with us, before our nikkah he made me sign on the nikkah papers that he is not responsible for him in any way, but at that time the situation was different. my son’s father (my ex-husband) was alive and he was to look after him after I got married but 2 years after my marriage he died and my kid became an orphan, so what are my responsibilities being a mother and what are the responsibilities of my husband in this scenario. In principle, a mother’s right to custody of her child drops when she remarries. The right will only return if she gets divorced. If your parents are unwell, then the next most deserving guardian for the child are the paternal grandparents. Then it is your full sister. Then it is your half-sister from your mum’s side. Then your half-sister from your dad’s side. Then your maternal aunties who have more right over your paternal aunties. Of course, if your sisters or aunties marry, their right to custody will also drop.<\/span><\/p>\n

If no female relatives are there to take care of the child, the male relatives then have the right of custody, starting with your brothers, etc.<\/span><\/p>\n

 <\/p>\n

However, if nobody in your family is willing to take custody of the child, then it will be permissible for you to take custody of your child if your husband agrees. However, in your case, it seems as though your husband did not agree at the time of your marriage. In this scenario, please try to make him understand that your son has nobody else to care for him and that you have no other choice. You should also consider that if you forcefully bring your son to live with you and your husband, then this could be a negative environment for your son, considering your husband will despise your son due to you breaking your promise at the time of marriage. So that is why your female relatives mentioned above have more right over you when it comes to custody of your child.<\/span><\/p>\n
