I will be getting a divorce, my husband wants to look after our 2 children half the time, which in reality means them only having food at his 3-4 times a week, but the rest of the time with me. They will be sleeping at my house mostly. He won’t pay for the rest of their maintenance because he’s giving me half the value of our current house so I can buy one for my children and me to live in.<\/span>
\nCan I please speak to someone about what my rights are if the children don’t want to live with their father?<\/span><\/p>\n

I can understand the difficult predicament you are in.<\/span><\/p>\n

 <\/p>\n

However, if you\u2019re asking from a legal point of view, you will need to speak to a solicitor who majors in family law, or you can seek advice from your local citizens\u2019 advice bureau, on occasion they hold free advisory clinics.<\/span><\/p>\n

 <\/p>\n

If you are asking from a Hanafi Fiqh perspective, the mother retains custody until the child reaches approximately\u00a0<\/span>seven years old<\/b>, the age at which he can independently manage basic needs.<\/span><\/span><\/p>\n

 <\/p>\n

For\u00a0<\/span>daughters<\/b>: The mother retains custody until the girl reaches\u00a0<\/span>puberty<\/b>.<\/span><\/span><\/p>\n

 <\/p>\n

These guidelines are based on the understanding that young children benefit from the care and nurturing of their mothers during early developmental stages.<\/span><\/p>\n

 <\/p>\n

Nevertheless, a mutual amicable agreement can be made between the couple as to make it easier for the children.<\/span><\/p>\n

 <\/p>\n

The maintenance for the child should be ongoing, though you have mentioned that the sale of the house will be used to help with the child\u2019s maintenance. Just a reminder that the child is also the father\u2019s responsibility until the child can fend for himself\/herself.<\/span><\/p>\n
