My father recently passed away, and my mother’s iddah has now begun. Prior to this event, she had purchased a Hajj package and made full payment. The Hajj season falls within her iddah period, and we are seeking guidance on whether there is any flexibility to fund someone else to perform Hajj badal on behalf of my mother although she is financially and physically able, she is prevented due to her iddah.<\/span><\/p>\n

A key concern is that she had made a vow almost 18 years ago to perform Hajj, if she were to recover when she was battling cancer. She has already completed her first obligatory Hajj, and this is a separate vow that must be fulfilled as soon as possible. Additionally, she has spent a significant portion of her savings on this trip which is non refundable.<\/span><\/p>\n

Answer:<\/strong><\/span><\/p>\n

It is indeed impermissible for a lady in iddah to travel for Hajj, whether it be her obligatory Hajj or not. Since your mother\u2019s vow appears to be a valid vow (and not an oath which can be expiated), she should fulfill that vow herself. For it to be valid for one to perform Hajj on a living person\u2019s behalf, that person must be physically unable to perform Hajj until they pass away. Since your mother\u2019s iddah is a temporary affliction, it does not seem like a Hajj done on her behalf would be valid unless there are other preventative circumstances which will continue to prevent her from performing Hajj in the future.<\/span><\/p>\n

You should investigate and personally contact the sellers of the Hajj package to see if any refund or delay until next year can be made available. If there is truly no leeway to be had, then you should see whether it is possible for someone (perhaps the one who was intending to do Hajj in your mother\u2019s stead) to buy the Hajj package from your mother so that she can retrieve her savings for now and perform Hajj in the future. As a precaution, she should also make sure to put a Hajj in her will if she has not done so already.<\/span><\/p>\n

Keep in mind that there is a world of difference between someone who does not fulfil their vow out of negligence and someone who tries to fulfil their vow to the best of their ability but is prevented by an unforeseeable tragedy. One should do what they are able and thereafter put their trust in the mercy and understanding of Allah (\u0639\u0632 \u0648 \u062c\u0644).<\/span><\/p>\n
