(This information i have found from internet) &nbsp; Imam Sufian Sauri says: ? If someone marries a woman to make her Halala (for her ex-husband) and then wants to keep her as wife, he is not permitted to do so unless he solemnises a Nikah afresh, as the previous Nikah was unlawful.? This is not correct. The meaning of <em>Halalah<\/em> is that if the woman after being divorced and after observing her <em>iddah <\/em>(waiting period) wished to marry another man, she can do so. This second husband on his own accord divorces her after having sexual intercourse with her then after observing the <em>iddah<\/em>, she can remarry her first husband. (The Complete system of Divorce p.53)<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">It should be borne in mind that this is not a solution provided by the Shariah. Once three divorces are pronounced, the marriage is over and there is no getting together again.<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">Saaiduna Abdullah Ibn Masud <img title=\"ra\u1e0dyAll\u0101hu 'anhu (may All\u0101h be pleased with him)\" alt=\"ra\u1e0dyAll\u0101hu 'anhu (may All\u0101h be pleased with him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/ranhu.png\" height=\"12px\"> narrates that the Prophet of Allah <img title=\"\u1e63allall\u0101hu 'alayhi wa sallam (peace and blessings of All\u0101h be upon him)\" alt=\"\u1e63allall\u0101hu 'alayhi wa sallam (peace and blessings of All\u0101h be upon him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/saw.png\" height=\"12px\"> cursed the Muhill (the one who makes halal) and the muhall lahu (for the one it is made halal.) (Sunan Tirimizi p.231 v.1)<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">According to the Hanafi Madhab if a woman enters into marriage with another man on the condition made verbally that he divorces her after consummating, the marriage is valid but severely disliked because of the aforementioned hadith. The woman will be free to marry the first husband.<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">If a person marries without placing a verbal condition but had an intention in his heart to divorce her after consummating the marriage so that she can become lawful for the first husband, this marriage will be considered permissible (Bahur Raaiq p.58 v.4, Fathul Qadir p.34 v.4 &amp; Dars Tirmizi p.399 v.3)<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">However, the view of Imam Shafi <img title=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" alt=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/rahimahu.png\" height=\"12px\"> and Imam Ahmad <img title=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" alt=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/rahimahu.png\" height=\"12px\"> is that whether a person places a condition or conceals it the marriage is not done. He is still a Muhill (the one who makes halal) and if he thereby intends to make her permissible for the first husband, then he is cursed. (Dars Tirimzi p.400 v.3)<\/span><\/span><\/span>\n<\/p>\n<p>\n\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">Regarding your question on Saaiduna Umar <img title=\"ra\u1e0dyAll\u0101hu 'anhu (may All\u0101h be pleased with him)\" alt=\"ra\u1e0dyAll\u0101hu 'anhu (may All\u0101h be pleased with him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/ranhu.png\" height=\"12px\"> punishing&nbsp;those who pre-planned halalah, there are two ways look at it:<\/span><\/span><\/span>\n<\/p>\n<ol>\n<li>\n<p>\n\t\t\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">He punished those who&nbsp;made a verbal condition for a pre planned halalah.<\/span><\/span><\/span>\n\t\t<\/p>\n<\/li>\n<li>\n<p>\n\t\t\t<span style=\"color:#000000;\"><span style=\"font-size: 14px;\"><span style=\"font-family: verdana,geneva,sans-serif;\">Saaiduna Umar <img title=\"ra\u1e0dyAll\u0101hu 'anhu (may All\u0101h be pleased with him)\" alt=\"ra\u1e0dyAll\u0101hu 'anhu (may All\u0101h be pleased with him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/ranhu.png\" height=\"12px\"> gave such a ruling to make it a deterrent for other people not to consider the issue of halalah after they had divorced their wives three times. It is similar to Saaiduna Umar <img title=\"ra\u1e0dyAll\u0101hu 'anhu (may All\u0101h be pleased with him)\" alt=\"ra\u1e0dyAll\u0101hu 'anhu (may All\u0101h be pleased with him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/ranhu.png\" height=\"12px\"> considering three talaqs to be three and not one to make it a deterrent so that people don&rsquo;t take the issue of talaq lightly. It has been reported from Saaidina Ibn-Abbas <img title=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" alt=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/rahimahu.png\" height=\"12px\"> that during the times of The Prophet of Allah (Allah bless him &amp; give him peace), Saaidina Abu Bakr <img title=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" alt=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/rahimahu.png\" height=\"12px\"> and during the first two years of the caliphate of Saaidina Umar <img title=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" alt=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/rahimahu.png\" height=\"12px\"> said three talaqs were taken as one. So Saaidina Umar <img title=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" alt=\"ra\u1e25imahull\u0101h (may All\u0101h have mercy upon him)\" class=\"islamic_graphic\" src=\"http:\/\/daruliftabirmingham.co.uk\/wp-content\/plugins\/islamic-graphics\/img\/black\/20\/rahimahu.png\" height=\"12px\"> said &ldquo;people are becoming haste prone in a matter in which there was a room for deferment for them.
