Zakat on Savings Which the Investor Does Not Have for the Full Lunar Year

Question

 

I’m an investor and it’s part of our trade where we often invest almost the whole amount that we occupy into buying goods.

I invest fully into a business/buy goods to sell. I am left with no money, only personal belongings, vehicles, households etc.

As soon as those goods get sold, ALLAH S.W.T gives me back the invested amount along with the profit and the cycle continues.

So the Nisab doesn’t fulfill the requirement of a Full Lunar year possession.

The total invested amount is a handful and I’m somewhat confused if Zakat is wajib on me or not?

Answer

 

For Zakat to become obligatory upon an individual the amount of nisab must be maintained for one entire year. In the case where the money is being used to invest and the amount of nisab is not being met for an entire year, it will not be obligatory to give Zakat. Therefore you have not met the conditions of zakat and it is not obligatory upon you in such a case.

(قَوْلُهُ: نِسْبَةً لِلْحَوْلِ) أَيْ الْحَوْلِ الْقَمَرِيِّ لَا الشَّمْسِيِّ كَمَا سَيَأْتِي مَتْنًا قُبَيْلَ زَكَاةِ الْمَالِ (قَوْلُهُ: لِحَوَلَانِهِ عَلَيْهِ) أَيْ لِأَنَّ حَوَلَانَ الْحَوْلِ عَلَى النِّصَابِ شَرْطٌ لِكَوْنِهِ سَبَبًا، وَهَذَا عِلَّةٌ لِلنِّسْبَةِ وَسُمِّيَ الْحَوْلُ حَوْلًا لِأَنَّ الْأَحْوَالَ تَتَحَوَّلُ فِيهِ، أَوْ لِأَنَّهُ يَتَحَوَّلُ مِنْ فَصْلٍ إلَى فَصْلٍ مِنْ فُصُولِهِ الْأَرْبَعِ

(وَمِنْهَا كَوْنُ الْمَالِ نِصَابًا) فَلَا تَجِبُ فِي أَقَلَّ مِنْهُ هَكَذَا فِي الْعَيْنِيِّ شَرْحِ الْكَنْزِ رَجُلٌ أَدَّى خَمْسَةً مِنْ الْمِائَتَيْنِ بَعْدَ الْحَوْلِ إلَى الْفَقِيرِ، أَوْ إلَى الْوَكِيلِ لِأَجْلِ الزَّكَاةِ ثُمَّ ظَهَرَ فِيهَا دِرْهَمٌ سَتُّوقَةٌ لَمْ تَكُنْ تِلْكَ الْخَمْسَةُ زَكَاةً لِنُقْصَانِ النِّصَابِ، وَإِذَا أَرَادَ أَنْ يَسْتَرِدَّ الْخَمْسَةَ مِنْ الْفَقِيرِ لَيْسَ لَهُ ذَلِكَ، وَلَهُ أَنْ يَسْتَرِدَّ مِنْ الْوَكِيلِ إنْ لَمْ يَتَصَدَّقْ بِهَا هَكَذَا فِي فَتَاوَى قَاضِي خَانْ.

وَمِنْهَا الْمِلْكُ التَّامُّ وَهُوَ مَا اجْتَمَعَ فِيهِ الْمِلْكُ وَالْيَدُ وَأَمَّا إذَا وُجِدَ الْمِلْكُ دُونَ الْيَدِ كَالصَّدَاقِ قَبْلَ الْقَبْضِ أَوْ وُجِدَ الْيَدُ دُونَ الْمِلْكِ كَمِلْكِ الْمُكَاتَبِ وَالْمَدْيُونِ لَا تَجِبُ فِيهِ الزَّكَاةُ كَذَا فِي السِّرَاجِ الْوَهَّاجِ وَأَمَّا الْمَبِيعُ قَبْلَ الْقَبْضِ فَقِيلَ لَا يَكُونُ نِصَابًا وَالصَّحِيحُ أَنَّهُ يَكُونُ نِصَابًا كَذَا فِي مُحِيطِ السَّرَخْسِيِّ.
