Domestic Abuse And The Right To Seek Divorce

Question: 

 

My sister has been in an abusive marriage. She has been married for 4 years now. If she gets into an argument with the husband, then the husband doesn’t let her use the phone and doesn’t let her leave the house. Also, she has admitted that sometimes she started the fight by swearing at husband because she was mad. However, the husband responded back very abusively by slapping her. Also he forcefully gives her oral sex by holding her hands down despite her telling her multiple times before she feels uncomfortable. But the husband keeps telling her he can do whatever he wants with her body. Can she get out of this marriage somehow? The husband is refusing to give her talaq.

Answer:

 

“Divorce is twice. Then either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allāh. But if you fear that they will not keep [within] the limits of Allāh, then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allāh, so do not transgress them. And whoever transgresses the limits of Allāh – it is those who are the wrongdoers. ۝ And when you divorce women and they have reached their term, then either retain them in a good manner or release them in a good manner, and do not keep them intending harm, to transgress [against them]. And whoever does that has certainly wronged himself. And do not take the verses of Allah in jest. And remember the favor of Allah upon you and what has been revealed to you of the Book and wisdom by which He instructs you. And fear Allah and know that Allah is Knowing of all things.۝” Surah Al-Baqarah (2:229 & 231) [1]

 

The Prophet ﷺ never hit, threatened or distressed any of his wives, and he always treated them with dignity, kindness and respect. No one should feel it is their duty to endure suffering, and neither should they be pressured into doing so, as it is the right of every human being to be treated in a good manner. As a Muslim woman, while your sister cannot deliver the divorce herself, she has the options of khula’ or faskh. Khula’ is a negotiation made between spouses for a divorce, where the husband agrees to grant the wife divorce for a price. If an agreement cannot be reached and the wife still desires a divorce, she can seek a Shari’ah Council to mediate the situation. If they deem her request for a divorce as valid, they may annul the marriage. When an Islamic court dissolves a marriage, this would be considered faskh (annulment), rather than khula’.[2]

 

“Indeed, Allāh orders justice and good conduct and giving [help] to relatives and forbids immorality and bad conduct and oppression. He admonishes you that perhaps you will be reminded.” Surah an-Nahl (16:90) [3]

 

In Islam, marriage does not give anyone the right to abuse their spouse, or force their spouse into acts which they dislike or are impermissible. It is the right of the wife that she receive her dowry and that the husband provides for her maintenance (food, clothing and finances (including a stipend), accommodation, safety and protection (both physically and emotionally), and that she is treated in a kind and just manner. The right of the husband is that his wife guards his home and personal assets in his absence, shows obedience in matters that Allah ﷻ has commanded, guards her chastity, and that she treats him in a good and just manner. It is the right of both spouses to make themselves available for normal intercourse with the other. Aside from these stipulated rights, everything else should be discussed and agreed upon in a fair and amicable manner between the spouses.[4]

 

It was narrated from Ibn ‘Abbas ﵁ that the Prophet ﷺ said: “The best of you is the one who is best to his wife, and I am the best of you to my wives.” [5]

 

A wife is only expected to listen to her husband as much as what Allah ﷻ has commanded a woman to do regarding her marital duties (i.e. that she is available for him). Therefore, it should not result in the disobedience of Allah ﷻ or the suppression of her rights and well-being, as this only results in oppression and further harm. A husband does not have free reign over his wife’s body. While it would be wrong for a wife to deny her husband normal intercourse if she is safely able to provide it (as this is part of the purpose of the nikah contract), the husband is not permitted to physically or mentally harm his wife, nor force her into intercourse, especially if it is abnormal or haram.[6]

 

The Prophet ﷺ has said: “There is no obedience to any human being if it involves disobedience to Allah ﷻ.” (Ahmad) [7]

 

In Islam, marriage is a sunnah which has been legislated for the purpose of both spouses protecting each other from immorality (zina) and attaining good deeds. Whilst it is compulsory (fardh) for a man to seek marriage when fears he will commit an immorality, it is in fact forbidden (haram) for him to pursue it if he is certain it will cause his wife injustice, and makhruh tahrimah if he fears this will likely be the case. This is because by causing a wife injustice, they are not only harming another human being, but also destroying the benefits the marriage was supposed to bring. Oral intercourse where impurities or sexual fluids enter the mouth or are ingested is impermissible (haram). Even if these impure substances do not enter the mouth, performing intercourse in such a manner is disliked, as it is an act which lacks modesty and shame, and is considered a form of humiliation. Your sister’s husband will be sinful for forcing your sister into acts that not only cause her harm and distress, but also for performing intercourse in such a manner.[8]

الْبَابُ الثَّامِنُ فِي الْخُلْعِ وَمَا فِي حُكْمِهِ وَفِيهِ ثَلَاثَةُ فُصُولٍ الْفَصْلُ الْأَوَّلُ فِي شَرَائِطِ الْخُلْعِ وَحُكْمِهِ وَمَا يَتَعَلَّقُ بِهِ الْخُلْعُ إزَالَةُ مِلْكِ النِّكَاحِ بِبَدَلٍ بِلَفْظِ الْخُلْعِ…

(وَحُكْمُهُ) وُقُوعُ الطَّلَاقِ الْبَائِنِ كَذَا فِي التَّبْيِينِ…

إذَا تَشَاقَّ الزَّوْجَانِ وَخَافَا أَنْ لَا يُقِيمَا حُدُودَ اللَّهِ فَلَا بَأْسَ بِأَنْ تَفْتَدِيَ نَفْسَهَا مِنْهُ بِمَالٍ يَخْلَعُهَا بِهِ فَإِذَا فَعَلَا ذَلِكَ وَقَعَتْ تَطْلِيقَةٌ بَائِنَةٌ وَلَزِمَهَا الْمَالُ كَذَا فِي الْهِدَايَةِ.

إنْ كَانَ النُّشُوزُ مِنْ قِبَلِ الزَّوْجِ فَلَا يَحِلُّ لَهُ أَخْذُ شَيْءٍ مِنْ الْعِوَضِ عَلَى الْخُلْعِ وَهَذَا حُكْمُ الدِّيَانَةِ فَإِنْ أَخَذَ جَازَ ذَلِكَ فِي الْحُكْمُ وَلَزِمَ حَتَّى لَا تَمْلِكَ اسْتِرْدَادَهُ كَذَا فِي الْبَدَائِعِ.

الطَّلَاقُ بِصَرِيحِهِ، وَكِنَايَاتِهِ، وَلَهُ كِتَابٌ مُفْرَدٌ، وَمِنْهَا اللِّعَانُ وَلَا تَقَعُ الْفُرْقَةُ إلَّا بِتَفْرِيقِ الْقَاضِي عِنْدَ أَصْحَابِنَا.

حَدَّثَنَا عَبْدُ الرَّحْمَنِ، حَدَّثَنَا سُفْيَانُ، عَنْ زُبَيْدٍ، عَنْ سَعْدِ بْنِ عُبَيْدَةَ، عَنْ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا طَاعَةَ لِبَشَرٍ فِي مَعْصِيَةِ اللَّهِ‏.‏

(وَأَمَّا صِفَتُهُ) فَهُوَ أَنَّهُ فِي حَالَةِ الِاعْتِدَالِ سُنَّةٌ مُؤَكَّدَةٌ، وَحَالَةِ التَّوَقَانِ وَاجِبٌ وَحَالَةِ خَوْفِ الْجَوْرِ مَكْرُوهٌ

(قَوْلُهُ: وَمَكْرُوهًا) أَيْ تَحْرِيمًا بَحْرٌ (قَوْلُهُ: فَإِنْ تَيَقَّنَهُ) أَيْ تَيَقَّنَ الْجَوْرَ حَرُمَ؛ لِأَنَّ النِّكَاحَ إنَّمَا شُرِعَ لِمَصْلَحَةِ تَحْصِينِ النَّفْسِ، وَتَحْصِيلِ الثَّوَابِ، وَبِالْجَوْرِ يَأْثَمُ وَيَرْتَكِبُ الْمُحَرَّمَاتِ فَتَنْعَدِمُ الْمَصَالِحُ لِرُجْحَانِ هَذِهِ الْمَفَاسِدِ بَحْرٌ وَتَرَكَ الشَّارِحُ قِسْمًا سَادِسًا ذَكَرَهُ فِي الْبَحْرِ عَنْ الْمُجْتَبَى وَهُوَ الْإِبَاحَةُ إنْ خَافَ الْعَجْزَ عَنْ الْإِيفَاءِ بِمُوجَبِهِ. اهـ. أَيْ خَوْفًا غَيْرَ رَاجِحٍ، وَإِلَّا كَانَ مَكْرُوهًا تَحْرِيمًا

كُلُّ مَا يَخْرُجُ مِنْ بَدَنِ الْإِنْسَانِ مِمَّا يُوجِبُ خُرُوجُهُ الْوُضُوءَ أَوْ الْغُسْلَ فَهُوَ مُغَلَّظٌ كَالْغَائِطِ وَالْبَوْلِ وَالْمَنِيِّ وَالْمَذْيِ وَالْوَدْيِ وَالْقَيْحِ وَالصَّدِيدِ وَالْقَيْءِ إذَا مَلَأَ الْفَمَ.

وَأَمَّا بَيَانُ مَا يَحْرُمُ أَكْلُهُ مِنْ أَجْزَاءِ الْحَيَوَانِ الْمَأْكُولِ فَاَلَّذِي يَحْرُمُ أَكْلُهُ مِنْهُ سَبْعَةٌ: الدَّمُ الْمَسْفُوحُ، وَالذَّكَرُ، وَالْأُنْثَيَانِ، وَالْقُبُلُ، وَالْغُدَّةُ، وَالْمَثَانَةُ، وَالْمَرَارَةُ لِقَوْلِهِ عَزَّ شَأْنُهُ ﴿وَيُحِلُّ لَهُمُ الطَّيِّبَاتِ وَيُحَرِّمُ عَلَيْهِمُ الْخَبَائِثَ﴾ [الأعراف: ١٥٧] وَهَذِهِ الْأَشْيَاءُ السَّبْعَةُ مِمَّا تَسْتَخْبِثُهُ الطِّبَاعُ السَّلِيمَةُ فَكَانَتْ مُحَرَّمَةً

فِي النَّوَازِلِ إذَا أَدْخَلَ الرَّجُلُ ذَكَرَهُ فِي فَمِ امْرَأَتِهِ قَدْ قِيلَ يُكْرَهُ وَقَدْ قِيلَ بِخِلَافِهِ كَذَا فِي الذَّخِيرَةِ
