Question:
As Salam Alaikum!
- Is there any evidence from the Sunnah that a person who has doubts in prayer only rarely (not frequently) is obliged to repeat the entire prayer rather than performing Sujud al-Sahw?
- Why do Hanafi scholars say that Sujud al-Sahw is performed only after the Salam, and why is only one Salam given to the right (instead of two salams)?
- I was saving money to move to another city for job hunting, and I did not know that Zakat is also payable on silver. If I spent that money several years ago without knowing that Zakat applies to silver, am I sinful for not having paid Zakat on it?
- When I was a student, I stole a DVD from one store and a couple of books from another store on a few occasions. The bookstore is still in business, but I don’t remember how many books I stole. The DVD store closed long ago. More than 15-20 years have passed. At that time, I did not pray, but I believed in Allah. What should I do to repent and make amends?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
In regards to your first two questions, in the Hanafi madhab the sajdah sahw (prostration of forgetfulness) becomes wajib upon a person who accidentally misses a wajib act, performs an extra action, significantly delays a pillar of salah, or if they perform the actions of salah in the wrong order. It is also due upon an individual who is experiencing doubt, but has a strong suspicion one of these actions had occurred. The sajdah sahw is for anyone who experiences the above and not only for those who experience regular doubt.[1]
In the Hanafi madhab, the most correct method of sajdah sahw is for it to be performed after making a single salam towards the right side after reciting the tashahhud of the last rakah of the salah. However, performing sajdah sahw before making the salam is valid, as both methods have been narrated in the hadeeth. The method of only making a single salam towards the right side before the two sajdahs of sahw is a sunnah according to the opinion of the majority of Hanafi scholars. The reason for this is due to the fact that the first salam is for both ending the prayer and greeting, whereas the second salam is solely for greeting. As only ending the salah is required for the sajdah sahw, the second salam is considered unnecessary and a form of speech, which is why it is omitted. Performing two salams is also valid so long as one does not talk or turn away from the Qiblah before performing the sajdah sahw.[2]
As for your second question, zakat becomes compulsory once a person has possessed wealth above the nisab amount for a full lunar year. An individual should not delay giving their zakat without an excuse, as to delay paying the zakat longer than a year from when it had become due (fardh) would render the person sinful. However, the unpaid zakat will still be due upon you for each missed year you possessed this silver. You will need to calculate how much was due each nisab year and give this total amount in zakat as soon as possible. If this is impossible, a genuine estimation should be made for each year, giving more in zakat as a precautionary measure.[3]
Lastly, any item obtained through haram means should be either returned or given in charity. It should be kept in mind that theft is a major sin, which is only forgiven through sincere repentance or an accepted Ḥajj. You should find out which books and DVDs you stole and calculate the cost of these items at the time of theft. As for what you were unsure about, you should give extra to cover these possible costs. In regards to the fact that the DVD store is now closed, I advise you research old business records online or ask locally to see if you can find the owners in order to return their money. After making a genuine attempt, if this proves unsuccessful, you should give the cost of the stolen DVDs as charity and make abundant du’a asking for forgiveness for committing such a sin.[4]
Only Allah ﷻ knows best.
