Question:
A lady entered haram without ihram as she was on her period. Does she have to go immediately back to miqat and enter into the state of ihram (and not enter haram until her period clears) or can she wait till her period ends? Does she give dam if she waits till her period ends?

Answer:
If a female is in menstruation, she is still required to recite the Talbiyah and make intention for Ihram prior to crossing the Meeqat. This is because menstruation does not prevent one from entering Ihram, rather menstruation simply prevents one from performing Tawaf and entering Masajid during Umrah/Hajj [1]. Thus, she has not followed the proper procedure by crossing the Meeqat without entering the state of Ihram.
If the female in question is intending to perform Umrah, must now enter Ihram from ‘Al-Hil’, which is any location beyond the boundary of the Haram until the Meeqat. She must also pay Damm (penalty: slaughter of a sheep/goat) due to crossing the Meeqat without Ihram. She does not need to return to the Meeqat from the Haram to enter Ihram because her Meeqat is now Al-Hil. If she is intending to perform Hajj, she will enter Ihram from the Haram itself and also pay Damm. [2]
