The Ruling On A Latecomer Joining The Imam During Tashahhud

Fatwa ID: 09471

Question:

  1. If the latecomer joins the Imam in the first or final tashahhud for even a moment, then does the latecomer finish his tashahhud before rising up (for either the third unit, or to complete his missed units)? If he did complete his first tashahhud while the Imam rose up for the third unit quite soon, then he would probably be behind the Imam.

  1. A latecomer makes the opening takbeer while the Imam is in the first tashahhud. If the Imam begins to rise for the third unit while the latecomer is going down, what does the latecomer do?

  1. A latecomer makes the opening takbeer while the Imam is in his final tashahhud. If the Imam says the first Salam while the latecomer is going down to join him, what does the latecomer do?

Answer:

Question 1

If the latecomer (Masbūq) joins the Imam in the first or final tashahhud, the latecomer (Masbūq) should finish his Tashahhud before rising, even if the Imam rises before him. [1, 2]

If the Imam rises before the follower completes his tashahhud, the preferred opinion is that the follower should complete the tashahhud. If he does not complete it, it is still valid. [1]

This is because the Tashahhud is a Wājib (necessary) act of Salāt, and falling behind the Imam momentarily (no more than 1 movement) to complete the Tashahhud is preferred over leaving the Tashahhud incomplete.

Question 2

If the Imam begins to rise for the third Rak’at while the latecomer is going down, the latecomer must follow the Imam. He should abandon going down for the Tashahhud and rise with the Imam.

And if he began with what he [the Imam] had previously done, his prayer would be invalid, because he [Muqtadī] acted alone in a situation where following the imam was obligatory. [4, 8]

Question 3

If the Masbūq performs the Takbīr Tahrīmah before the Imam says Salām, he has joined the Imam’s Salāt. [5, 6] If he joins after, he has missed the Salāt and must restart the prayer separately. [5, 6]

If the Masbūq catches the Imam whilst in Tashahhud, he must finish the Tashahhud before getting up to make up the missed Raka’āt. [, 2, 3, 7] If the Masbūq joins before the first Salām and could not go down in time and misses the Tashahhud with the Imam (who is now finished), the Masbūq should abandon the Tashahhud, get up, and make up the missed Raka’āt.
