Question:
My father-in-law now has three houses, one in Pakistan which is going to be rented out when not used, one recently bought which is being renovated, and one he is currently living in, two of the houses have been recently bought so have not reached a full year, but would like to ask in advance, and most probably by the time they reach a full year in ownership the one they are currently residing in will be sold, so I wanted to confirm if zakaat should be given for both houses inshallah, JazaakAllah khair

Answer:
Regarding zakāt on your father in laws three houses:
- Rental House:
If your father-in-law possesses a rental property in Pakistan, he will not be liable to pay zakāt on the value of the property. Instead, if the rental income reaches the value of nisāb, and remains for a complete Islamic year or the said person is a possessor of nisāb and pays zakāt on his other assets,[cash, gold silver etc], this rental income will form part of the other cash and will be subject to zakāt.

ولَوْ آجَرَ عَبْدَهُ أوْ دارِهِ بِنِصابٍ إنْ لَمْ يَكُونا لِلتِّجارَةِ لا تَجِبُ ما لَمْ يَحُلْ الحَوْلُ بَعْدَ القَبْضِ فِي قَوْلِهِ، وإنْ كانَ لِلتِّجارَةِ كانَ حُكْمُهُ كالقَوِيِّ؛ لِأنَّ أُجْرَةَ مالِ التِّجارَةِ كَثَمَنِ مالِ التِّجارَةِ فِي صَحِيحِ الرِّوايَةِ اهـ.
- Personal Residential House:
There is no zakāt on personal property which is not acquired specifically for reselling.
اللباب في شرح الكتاب ١/١٣٧ — الميداني، عبد الغني
وليس في دورٍ السكنى، وثياب البدن، وأثاث المنازل، ودواب الركوب، وعبيد الخدمة، وسلاح الاستعمال – زكاةٌ، ولا يجوز أداء الزكاة إلا بنيةٍ مقارنةٍ للأداء أو مقارنةٍ لعزل مقدار الواجب.
وإن كان ماله أكثر من الدين زكى الفاضل إذا بلغ نصابا وليس في دور السكنى وثياب البدن وأثاث المنازل ودواب الركوب وعبيد الخدمة وسلاح الاستعمال زكاة
- New House:
If the house is bought with the intention to resell then zakāt will be due on it after a year. But if the intention is to use it for staying in it then no zakāt will be due.
