Can Zakat Can Be Given For The Implants That Go In The Patient’s Body

Question:

 

A surgeon has travelled to Gaza from the UK to perform surgery on injured patients. He is asking if zakat can be used for the implants that go in the patient’s body and all attachments, screws etc.

 

My understanding is that tamleek is established. Am I correct in my understanding?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

 

Answer:

 

In these trying times for Gaza, the people are currently known as poor- they would be defined as the poor: he who does not have a quorum, and he has enough for him, and does not ask people. And the poor: he who has nothing, and he asks people, and does not find sustenance.[1]

There is specific eight people that the Almighty has mentioned in Surah Tawbah: 60 who zakat would be permissible for: ‘“Alms are only for the poor and the needy, and those who work in them, and for those whose hearts are reconciled, and for freeing slaves and debtors, and in the path of God, and for the wayfarer, an obligatory duty Indeed, God is All-Knowing, All-Wise”

The victims of this war would be classed as the needy.

 

Zakat is what completed the bond of Islamic unity due to its kindness to the lower class of people, who are the poor, who are of course the majority, by consoling them and removing their illnesses, and it is the greatest guarantee for their lives and the security of their families, increasing the spread of the call, strengthening those before whom the religion was not established, and freeing war slaves, and they were many. Also, and the expenditure in jihad, all of this is grateful to the Islamic League and National Unity. The Almighty said: {Alms are only for the poor and the needy and those who work in them and those whose hearts are reconciled and for freeing slaves and those in debt, and for the sake of God The wayfarer is an obligation from God} 4. This is a statement of the eight categories to whom zakat is paid.[2]

 

Therefore, in this scenario, it would be permissible for the surgeon to use for implants and equipment for their use, and yes tamleek will have been established.

[2] إن الزكاة هي التي تممت ربط الوحدة الإسلامية لعطفها على الطبقة السفلى من الناس, وهم الفقراء الذين هم الأغلب طبعًا, بمواساتهم وإزاحة عللهم, وهي الضمان الأكبر لحياتهم وأمن غائلتهم, وزيادة نشر الدعوة وتثبيت من لم يستقر الدين في قبله, وعتق أرقاء الحرب، وكانوا أكثرين أيضًا، والنفقة في الجهاد، كل ذلك ممتن للرابطة الإسلامية والوحدة القومية، قال تعالى: {إِنَّمَا الصَّدَقَاتُ لِلْفُقَرَاءِ وَالْمَسَاكِينِ وَالْعَامِلِينَ عَلَيْهَا وَالْمُؤَلَّفَةِ قُلُوبُهُمْ وَفِي الرِّقَابِ وَالْغَارِمِينَ وَفِي سَبِيلِ اللَّهِ وَابْنِ السَّبِيلِ فَرِيضَةً مِنَ اللَّهِ} ٤. فهذا بيان الأصناف الثمانية الذين تدفع لهم الزكاة.
