Nikah with a Shia Person

Question:

 

Is it permissible to get married between Sunni Boy and Shia Girl? If Nikah Khawan is Shia then explain whether this Nikah is right or not., and should a Sunni Nikah-Khawan should have made Nikah again or he is not permitted to do so. Your prompt response will be highly appreciated.

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

One of the conditions for a valid Nikaah is that the husband and wife must be of the same religion1, ie. both should be Muslim, or the man Muslim and the woman Christian or Jew.

 

However, when it comes to Shias, whether the man is Shia or the woman, the answer would depend on whether that specific individual has beliefs which contradict Islam or not.

 

It is important to note that within Shias, there are many different groups and categories. And not all of these groups and categories have beliefs which take them out of the fold of Islam. Some of them are still considered Muslims. Therefore, we cannot give a blanket ruling and say that Nikaah with all Shias is permissible or impermissible. It would differ based on each individual.

 

Hence, if the person is such that their Aqaaid (core beliefs) align with those of the Ahlus Sunnah Wal Jamaa’ah, then yes, Nikaah with them will be permissible. However, if this person has such beliefs which take them out of the fold of Islam, then this will not be allowed, as Muslims are not allowed to marry non-Muslims.
