Question:

 

If someone is doing a mua’malah on whats app and after the one party says, I will pay 500 monthly and the other person replies with a 👍. 

 

Will this be considered qabool?

 

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

 

Answer:

 

A deal is made with a proposal and an acceptance agreement on a price and the item.

 

If this sign is commonly used for people in their dealings, then it will be counted as qabool.

 

Nowadays it is known that when a person uses this sign, it means that he agrees with what you said.

 

It will therefore be concluded by the person replying to that sign after what you have mentioned to him.

قَالَ ﵀ (الْبَيْعُ يَنْعَقِدُ بِالْإِيجَابِ وَالْقَبُولِ) الِانْعِقَادُ هَاهُنَا تَعَلُّقُ كَلَامِ أَحَدِ الْعَاقِدَيْنِ بِالْآخَرِ شَرْعًا عَلَى وَجْهٍ يَظْهَرُ أَثَرُهُ فِي الْمَحَلِّ. وَالْإِيجَابُ الْإِثْبَاتُ. وَيُسَمَّى مَا تَقَدَّمَ مِنْ كَلَامِ الْعَاقِدَيْنِ إيجَابًا لِأَنَّهُ يَثْبُتُ لِلْآخَرِ خِيَارُ الْقَبُولِ، فَإِذَا قَبِلَ يُسَمَّى كَلَامُهُ قَبُولًا وَحِينَئِذٍ لَا خَفَاءَ فِي وَجْهِ تَسْمِيَةِ الْكَلَامِ الْمُتَقَدِّمِ إيجَابًا وَالْمُتَأَخِّرِ قَبُولًا. وَشَرْطُهُ أَنْ يَكُونَ الْإِيجَابُ وَالْقَبُولُ بِلَفْظَيْنِ
