Question:
- If a woman says before her marriage, “I will be” while thinking of conditional divorce, Will she be divorced after marriage when her husband gives her the right of the talaq and when the condition is fulfilled automatically even if she doesn’t pronounce it after having the right?

Answer:
In Hanafi fiqh, a divorce can only take effect once a valid marriage has taken place. If a woman thinks or says something related to a conditional divorce before marriage, those statements hold no legal effect after she gets married, even if her husband later gives her the right to divorce herself.
However, divorce is a serious matter in Islam, and one should exercise extreme caution with words and intentions. Sometimes, a statement made in anger or without proper understanding can lead to unintended consequences. While divorce is permissible in Islam, it is considered the most disliked halal act by Allah (SWT) because preserving the family unit is of great importance in Islamic teachings.

(ولا يصح إضافة الطلاق) أي تعليقه (إلا أن يكون الحالف مالكا) للطلاق حين الحلف، كقوله لمنكوحته: إن دخلت الدار فأنت طالق (أو يضيفه إلى ملك)، كقوله الأجنبية: إن نكحتك فأنت طالق (وإن) لم يكن مالكا للطلاق حين الحلف ولم يضفه إلى ملك بأن (قال لأجنبية: إن دخلت الدار فأنت طالق، ثم تزوجها فدخلت الدار لم تطلق)، لعدم الملك حين الحلف والإضافة إليه
