Question: 

 

 

Assalamu alaykum, 

 

  

Would it be permissible to sue a surgeon if something goes wrong during surgery? Any material on this and related issues? 

 

 

 

 

 

In the name of Allah, the Most Gracious, the Most Merciful 

 

 

Answer 

 

 

Waaliakum salaam warahmatullahi wabarakaatuhu

 

 

If a person incurred any loss due to the actions or negligence of another, it will be permissible to seek recompensation or remuneration for physical, material or any other damages caused, by means of suing or any other permissible ways.

 

 

However one should bear in mind that one should be honest, avoiding deception or over-claiming  

 

 

And Allah Ta allah knows best.
