Question:

If by the age of 40 ish, i have enough funds in my pensions to go for Hajj, does it become obligatory on me to withdraw the amount and use it on Hajj?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

If you have a house and have the means to fulfill your other necessities such as food and drink, clothing, etc. besides your pension money, it will be necessary to withdraw the amount and use it on Hajj. That is, if you have enough means to provide for your family while you’re gone. Another condition is that you should be able to access that money. Some pension funds don’t allow the owner to access it until they retire or they leave their job. If that’s the case, Hajj will only become necessary once you have access to that money.

وهو (واجب) (١): أي فرض في العمر مرة (على الأحرار البالغين العقلاء الأصحاء إذا قدروا على الزاد) ذهابًا وإيابًا (والراحلة) من زاملة أو شق محمل (فاضلًا): أي زائدًا ذلك (عن مسكنه وما لا بد) له (منه) كالثياب وأثاث المنزل والخادم ونحو ذلك؛ لأنها مشغولة بالحاجة الأصلية (و) زائدًا أيضًا (عن نفقة عياله) ممن تلزمه نفقته (إلى حين عوده) لتقدم حق العبد لحاجته

هل الحج واجب على الفور أم على التراخي

(ثُمَّ هو واجبٌ على الفورِ (٢) عند أبي يوسف (٣) ﵀.

أي: ثُمَّ بَعْدَ اسْتِجْمَاعِ شَرَائِطِ الْوُجُوبِ يَجِبُ عَلَى الْفَوْرِ، حَتَّى يَأْثمَّ بِالتَّأْخِيرِ عِنْدَ أَبِي يُوسُفَ رَوَاهُ عَنْهُ بِشْرُ بْنُ الْمُعَلَّى (٤).

(وعند أبي حنيفة ﵀ ما يدل عليه).

أي: على الفور، وهو: ذَكَرَ ابْنُ شُجَاع عَنْ أَبِي حَنِيفَةَ ﵀ قَالَ: سُئِلَ عَمَّنْ لَهُ مَالٌ أَيَحُجُّ بِهِ أَمْ يَتَزَوَّجُ، قَالَ: بَلْ يَحُجُّ بِهِ، فَذَلِكَ دَلِيلٌ عَلَى أَنَّ الْوُجُوبَ عِنْدَهُ عَلَى الْفَوْرِ، كذا ذكره في «المبسوط» (٥) في باب الحجّ، عن الميت وغيره
