Istisnāʿ Contracts and the Use of Third-Party Manufacturers

Question:

 

In istisna’ type of online contract, if the manufacturer takes an order from the customer and assigns a third-party to print as well as ship/deliver the product to the customer, will the contract be correct?

 

Secondly, is it necessary for the manufacturer to mention in the product page, that the product will be printed and shipped from third-party printers?

Answer:

 

An istisna contract is valid providing the delivery date is determined and the item is described.

 

With regards to the manufacturer mentioning the product will be printed and shipped from a third party is necessary as there should be no ambiguity in transactions it should be made clear.

كل شئ تعومل بيعه بالاستصناع يصح فيه على الاطلاق إذا وصف المصنوع وعرفه على الوجه الموافق المطلوب ويلزم، وليس لاحدهما الرجوع إذا كان على الاوصاف المطلوبة، وإذا خالف يكون المشتري مخيرا.

وأما ما لا يتعامل استصناعه إذا بين فيه المدة صار سلما فتعتبر فيه حينئذ شرائط السلم، وإذا لم يبين فيه المدة كان من قبيل الاستصناع أيضا.
