Question:
I had my Nikkah registered as I got married in Pakistan and in 2021. I applied for a divorce and was granted a decree absolute. Does Sharia Law consider/accept this enough for divorce?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
A decree absolute is when a judge dissolves the marriage upon the request of the wife. In this case the judge seeks authority from the husband to act on his behalf as a deputy/representative. “The talaq issued by a representative is sound” [Fatawa Hindiyyah – Chapter of Agency – V3 Pg 560 – Matba’a Al Kubra Al Amiriyyah]. Therefore, the sharia does consider a decree absolute sufficient as a divorce.
