Question:
Salams Mufti Sahib,
I hope you and the family are well.
Sorry for disturbing you at this time, but I had a question.
When you pay your tax to HMRC early, they then pay you interest on this early payment.
Can I take this money, which is in the name of the Ltd company?
If yes, can it be utilized as normal?

Answer:
Wa ʿalaykumu s-salam waRahmatullahi Wabarakatuh,
There is a mas’alah where the creditor says ‘Pay me early, and I will waive part of your debt,’ it is valid provided it was not stipulated as a condition.
This means that the creditor waives the amount voluntarily, without it being a formal condition, and the remainder is treated without stipulation.
Your situation is akin to the aforementioned mas’alah, in the sense that it was not forced upon them to give you that extra money, nor were you forced to pay early to receive that extra money. Hence, it will be allowed to use such money.

٢- الوضع عند التعجيل من غير شرط
و كذلك المنع من الوضع بالتعجيل في الديون المؤجلة إنما يكون إذا كان الوضع للدائن أن يضع عنه بعض دينه تبرعاً، و عليه حمل الجصاص رحمه الله الآثار التي تدل على جواز (ضع و تعجّل) قال رحمه الله : ( و من أجاز من السلف إذا قال: عجّل لي و أضع عنك، فجائز، أن يكون أجازوه إذا لم يجعله شرطاً فيه، و ذالك بأن يضع عنه بغير شرط، و يجعل الآخر الباقي بغير شرط).
