Distribution Of Inheritance For A Deceased Father: Share of Wife, Son, and Daughters

Question:

 

My father passed away some years ago but we have received some money from land that was recently sold in India. My late fathers share has been passed to my mother, 3 sisters and myself (son). If you can advise how this should be distributed between us.

 

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

In this scenario, the recipients of your father’s inheritance are from the Dhawil-Furud—they have a stipulated share.[1]

 

Due to such, the distribution will be as follows:

 

1. Your mother will receive 1/8th of the estate (12.5%)
2. Your sisters will receive 7/40th of the estate (17.5%)
3. You (the son) will receive 7/20th of the estate (35%)

 

The son will receive double the inheritance of the sisters. Therefore, if the money from the sold land was $200,000 for example, then your mother will receive $25,000., your sisters will receive $35,000 (each) and you will receive $70,000.

يُوصِيكُمُ ٱللَّهُ فِيٓ أَوۡلَٰدِكُمۡۖ لِلذَّكَرِ مِثۡلُ حَظِّ ٱلۡأُنثَيَيۡنِۚ فَإِن كُنَّ نِسَآءٗ فَوۡقَ ٱثۡنَتَيۡنِ فَلَهُنَّ ثُلُثَا مَا تَرَكَۖ

وَإِن كَانَتۡ وَٰحِدَةٗ فَلَهَا ٱلنِّصۡفُۚ وَلِأَبَوَيۡهِ لِكُلِّ وَٰحِدٖ مِّنۡهُمَا ٱلسُّدُسُ مِمَّا تَرَكَ إِن كَانَ لَهُۥ وَلَدٞۚ فَإِن لَّمۡ يَكُن لَّهُۥ وَلَدٞ وَوَرِثَهُۥٓ أَبَوَاهُ فَلِأُمِّهِ ٱلثُّلُثُۚ فَإِن كَانَ لَهُۥٓ إِخۡوَةٞ فَلِأُمِّهِ ٱلسُّدُسُۚ مِنۢ بَعۡدِ وَصِيَّةٖ يُوصِي بِهَآ أَوۡ دَيۡنٍۗ ءَابَآؤُكُمۡ وَأَبۡنَآؤُكُمۡ لَا تَدۡرُونَ أَيُّهُمۡ أَقۡرَبُ لَكُمۡ نَفۡعٗاۚ فَرِيضَةٗ مِّنَ ٱللَّهِۗ إِنَّ ٱللَّهَ كَانَ عَلِيمًا حَكِيمٗا
