Question:

 

A muslim hired a hindu contractor for some work. The contractor completed the work and the muslim has some interest money left over. Can he pay the hindu contractor with that interest money?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

 

Answer:

 

Firstly, it is absolutely impermissible for one to earn money through interest. One should only deposit their money in a non-interest yielding account.

 

You may not pay the Hindu contractor with the interest money. You must either:

 

• Return the interest money to whoever provided you with this Haram money.
• If it is not possible for you to return this wealth to the supplier, then you must discharge the interest money to poor and needy people without expecting any Thawab (reward) from this donation.

 

Hence, you cannot derive any benefit from the interest money. You must pay the Hindu contractor from wealth which is not acquired through interest.

لِأَنَّ الْوَاجِبَ حَقًّا لِلشَّرْعِ رَدُّ عَيْنِ الرِّبَا لَوْ قَائِمًا لَا رَدُّ ضَمَانِهِ اهـ وَاسْتَحْسَنَهُ فِي النَّهْرِ.

حَدَّثَنَا آدَمُ، حَدَّثَنَا شُعْبَةُ، حَدَّثَنَا عَوْنُ بْنُ أَبِي جُحَيْفَةَ، عَنْ أَبِيهِ، قَالَ لَعَنَ النَّبِيُّ صلى الله عليه وسلم الْوَاشِمَةَ، وَالْمُسْتَوْشِمَةَ، وَآكِلَ الرِّبَا وَمُوكِلَهُ، وَنَهَى عَنْ ثَمَنِ الْكَلْبِ، وَكَسْبِ الْبَغِيِّ، وَلَعَنَ الْمُصَوِّرِينَ‏.‏

Narrated Abu Juhaifa: The Prophet (ﷺ) cursed the lady who practices tattooing and the one who gets herself tattooed, and one who eats (takes) Riba’ (usury) and the one who gives it. And he prohibited taking the price of a dog, and the money earned by prostitution, and cursed the makers of pictures.
