Entitlement To Mahr And Gold After Marriage Annulment (Faskh)

Question:

 

I hope you are well. I am seeking a fatwa regarding the status of gold in an annulment based on my circumstances.

 

I was in a marriage that has now ended, via annulment. I would like to clarify whether my former spouse is entitled to any of the gold from our marriage.

 

Would a fatwa have instructed me to return any gold in this situation, or is it considered my rightful possession?

 

I went with the fatwa in London. They dissolved the marriage. They asked if I wanted to give anything to the ex, I said no I wanted justice and thus the ex did not sign and the matter went to a faskh, based on the evidence I had provided of all the injustice during the marriage.

 

I possess the mahr.

 

I seek guidance on the correct course of action in accordance with Islamic principles.

Answer:

 

It is important that an attempt at seeking Khula’ is made before a judgement of Faskh is passed. Nevertheless, given that a Faskh has occurred and not a Khula’, you are not obligated to give or return anything to the husband [1]. Rather, if it is as you say and your husband was the one at fault, then it is better that he takes nothing in return [2].
