Question:

Are lipases ingredients halal?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

Lipase is a type of enzyme that is used in the cheese-making process. Lipase can be made using two sources: animal products or micro-organisms. Lipase made using microorganisms is halal by consensus. As for the lipase which is animal-based, the animal must be an animal that is permissible for consumption and can’t be pork-based. There is a difference of opinion within the Hanafi Madhab as to whether or not the animal must be slaughtered in accordance with Shariah for the lipase to be considered Halal. Imam Abu Hanifah’s opinion, which is the majority opinion of the Madhab, is that even if the animal were to be slaughtered in a non-Islamic way, the lipase would be permissible to consume.

مسألة:] حكم البيضة الخارجة من الدجاجة بعد موتها [

قال: (ومن ماتت له دجاجة، فخرجت منها بيضة: فلا بأس بأكلها).

والأصل في ذلك: أنَّ كل ما يستباح من الحيوان في حال حياته بغير ذكاة، فحاله بعد الموت كهي قبله، وذلك لأنه لا يلحقه حكم الموت

الشَّيْخُ بَيْضَ الْمَيْتَةِ وَلَبَنَهَا فَنَقُولُ الدَّجَاجَةُ إذَا مَاتَتْ وَخَرَجَتْ مِنْهَا بَيْضَةٌ بَعْدَ مَوْتِهَا فَهِيَ طَاهِرَةٌ يَحِلُّ أَكْلُهَا عِنْدَنَا سَوَاءٌ اشْتَدَّ قِشْرُهَا أَمْ لَا؛ لِأَنَّهُ لَا يُحِلُّهَا الْمَوْتُ،.

المبسوط للسرخسي ٥/‏١٣٩ 

أَحَدُهُمَا أَنَّ اللَّبَنَ لَا يَمُوتُ عِنْدَنَا؛ لِأَنَّهُ لَا حَيَاةَ فِيهِ، أَلَا تَرَى أَنَّهُ يُحْلَبُ فِي حَالَةِ الْحَيَاةِ مِنْ الْحَيَوَانِ فَيَكُونُ طَاهِرًا وَمَا فِيهِ الْحَيَاةُ إذَا بَانَ مِنْ الْحَيِّ يَكُونُ مَيِّتًا، فَإِذَا لَمْ يَكُنْ فِي اللَّبَنِ حَيَاةٌ لَا يَتَنَجَّسُ بِالْمَوْتِ بَلْ عِنْدَ أَبِي حَنِيفَةَ – رَحِمَهُ اللَّهُ تَعَالَى – يَبْقَى طَاهِرًا وَعِنْدَهُمَا يَتَنَجَّسُ بِنَجَاسَةِ الْوِعَاءِ كَمَا فِي إنْفَحَةِ الْمَيْتَةِ، فَكَأَنَّهُ حَلَبَ لَبَنَ امْرَأَةٍ فِي قَارُورَةٍ نَجِسَةٍ فَأَوْجَرَ الصَّبِيَّ بِهِ فَيَثْبُتُ بِهِ الْحُرْمَةُ،
