Being in Ihraam When Passing by the Meeqat

Question

 

Assalamu Alaikum Dear Mufti Sb.

I am in a group that came from Pakistan for Hajj (Tamattu). After performing Umrah now we are going to Madina. Some of our colleagues say that they have already performed Umrah and they are not going to perform Umrah while returning from Madina. They are to put on Ihram for Hajj which is done from Makkah, Therefore on return from Madina they would come to Makkah without Ihram and put on their Ihram for Hajj once they are back. It means they will cross meeqat without ihram. Are they right in their assertions? If not what is the correct way to do it as per Shariah. If there is any difference of opinion among different schools on this particular point.

Answer:

 

If you leave the vicinity of the Meeqaat and then re-enter for the days of Hajj, it MUST be in the state of Ihram. By not doing so a sacrifice is obligatory.
