Can men wear underwear in the state of Ihraam

Question:

Is it permissible for a male in the state of Ihram to wear under wear example shorts etc due to bladder problems, if not what should he do?

Will it be permissible to have the lower part of the Ihram stitched to avoid opening of the Satar (private parts)?

Answer:

Bismillah

In the aforementioned scenario, as your uncle has a chronic illness, he will be considered as Mazoor. He can wear underwear in the state of Ihraam; however, he will still be required to give some sort of compnsation which I will insha Allah explain below.

The penalty for wearing sewn clothing in the sate of Ihraam

  • If a man wore a sewn item for one day or night (i.e. for 12 hours) then Damm is obligatory.
  • If a man wore it for one hour then the amount of Sadaqah Fitr (approximately £2 to £3 will be obligatory). If he wore it for less than an hour, some money (less than the above figure) should be given to charity. (Kitabul Hajj p.93)

The word Damm refers to slaughtering of a sheep or goat or participating in one seventh of a cow, buffalow or a camel. It must be slaughtered in the precincts of the Haram.  The Damm will not be discharged if it is slaughtered beyond the precincts of the Haram.  (Mu’allimul Hujjaj p.263- p.264)

The penalty for wearing sewn clothing with an excuse in the sate of Ihraam

  • If Damm becomes obligatory due to an excuse, then where the penalty was Damm (i.e. wearing the sewn clothing for 12 hours) one now will have the option to fast for three days or give six poor people the amount of Sadaqah Fitr or sacrifice a sheep. (Kitabul Hajj p.101)

Allah subḥānahu wa ta'āla (glorified and exalted be He) in the Holy Qur’an says:

“…And whosoever of you is ill or has an ailment in his scalp (necessitating shaving), he must pay a Fidyah (ransom) of either observing Saum (fasts) (three days) or giving Sadaqah (charity – feeding six poor persons) or offering sacrifice (one sheep)…” (Surah Baqarah v.196)

  • Where Sadaqah is mentioned one has the option of giving that Sadaqah or fasting one day.

Finally, it will be permissible to have the lungi or loin cloth stitched down the middle. (Raddul Muhtar p.577 v.3)
