Question:

Someone didn’t realize it was Ashura and drank water after fajr time had entered. He didn’t have any intention the night before. Can intention still be made to fast now that he realized?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

If a person drinks water after fajr time has entered, the fast will not be valid. In principle, a person can make an intention of nafl fast until nisf al- nahar meaning exactly half time between subah al- sadiq and sunset of the day, on the condition that the person did not eat anything after fajr time entered.
