Conducting a Business Deal in the State of Major Impurities

Question:

 

If a person who is impure (because of sexual activity), conducts a business transaction before ghusl, will the transaction be correct?

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

The business transaction will be valid without ghusl.

 

For a business deal to be concluded the offer and acceptance is necessary. After the price is paid, the item is handed over to the purchaser. Ghusl is not a condition to make a business transaction.

وَشَرْطُ الْعَقْدِ اثْنَانِ أَيْضًا: مُوَافَقَةُ الْإِيجَابِ لِلْقَبُولِ، فَلَوْ قَبِلَ غَيْرَ مَا أَوْجَبَهُ أَوْ بَعْضَهُ أَوْ بِغَيْرِ مَا أَوْجَبَهُ أَوْ بِبَعْضِهِ لَمْ يَنْعَقِدْ إلَّا فِي الشُّفْعَةِ بِأَنْ بَاعَ عَبْدًا وَعَقَارًا فَطَلَبَ الشَّفِيعُ الْعَقَارَ وَحْدَهُ، وَكَوْنُهُ بِلَفْظِ الْمَاضِي
