Does a Mentally Ill Person Pay Fidyah for His Missed Fasts

Question:

 

If a person is considered mentally ill, they are not aware of what they are doing and need help to do everything, they are not under the obligation to fast.

 

However, must Fidyah still be paid for this individual or is that forgone since the obligation of fasting was never Fardh on them?

Answer:

 

In a Hadith, it is narrated by Sayyiduna Ibn Abbas (رضي الله عنهما) who said: “A lunatic woman passed by Ali ibn Abi Talib. [رضي الله عنه ] and that Sayyiduna Ali ibn Abi Talib (رضي الله عنه) said: “Do you not remember that the Messenger of Allah (ﷺ) has said: “There are three whose actions are not recorded: a lunatic whose mind is deranged till he is restored to consciousness, a sleeper till he awakes, and a boy till he reaches puberty?  (Sunan Abi Dawud 4401)

 

This above Hadith and many other Ahadith clearly mentions that an insane/mentally ill person is not Mukallaf meaning it is not incumbent upon him to do any act of worship as long as he remains in his state.

 

As a result, in the above-given situation, that person is not entitled to give any Fidiyah as it is required only upon whom Salah/Sawm was incumbent. [ CITATION زينضى \l 1033 ][ CITATION عبدات \l 1033 ][CITATION الجص5 \l 1033 ]
