Question:

Is there a valid difference of opinion on whether the translation of the Qur’ān takes the ḥukm (ruling) of the Qur’ān or of tafsīr?

In the name of Allāh, the Most Gracious, the Most Merciful

Answer:

The translation of the Qur’ān is likened to the tafsīr of the Qur’ān. However, caution would dictate that a translation of the Qur’ān be treated with respect in all aspects, in honour of the meanings of the Qur’ān itself. – (See: Rad Al-Muḥtār, Vol 1, Page 177 Dār Al-Fikr[1])

[1] فَإِنَّ مَا فِي الْأَشْبَاهِ صَرِيحٌ فِي جَوَازِ مَسِّ التَّفْسِيرِ فَهُوَ كَسَائِرِ الْكُتُبِ الشَّرْعِيَّةِ بَلْ ظَاهِرُهُ أَنَّهُ قَوْلُ أَصْحَابِنَا جَمِيعًا وَقَدْ صَرَّحَ بِجَوَازِهِ أَيْضًا فِي شَرْحِ دُرَرِ الْبِحَارِ وَفِي السِّرَاجِ عَنْ الْإِيضَاحِ أَنَّ كُتُبَ التَّفْسِيرِ لَا يَجُوزُ مَسُّ مَوْضِعِ الْقُرْآنِ مِنْهَا وَلَهُ أَنْ يَمَسَّ غَيْرَهُ وَكَذَا كُتُبُ الْفِقْهِ إذَا كَانَ فِيهَا شَيْءٌ مِنْ الْقُرْآنِ بِخِلَافِ الْمُصْحَفِ فَإِنَّ الْكُلَّ فِيهِ تَبَعٌ لِلْقُرْآنِ وَالْحَاصِلُ أَنَّهُ لَا فَرْقَ بَيْنَ التَّفْسِيرِ وَغَيْرِهِ مِنْ الْكُتُبِ الشَّرْعِيَّةِ عَلَى الْقَوْلِ بِالْكَرَاهَةِ وَعَدَمِهِ وَلِهَذَا قَالَ فِي النَّهْرِ وَلَا يَخْفَى أَنَّ مُقْتَضَى مَا فِي الْخُلَاصَةِ عَدَمُ الْكَرَاهَةِ مُطْلَقًا لِأَنَّ مَنْ أَثْبَتَهَا حَتَّى فِي التَّفْسِيرِ نَظَرَ إلَى مَا فِيهَا مِنْ الْآيَاتِ وَمَنْ نَفَاهَا نَظَرَ إلَى أَنَّ الْأَكْثَرَ لَيْسَ كَذَلِكَ وَهَذَا يَعُمُّ التَّفْسِيرَ أَيْضًا إلَّا أَنْ يُقَالَ إنَّ الْقُرْآنَ فِيهِ أَكْثَرُ مِنْ غَيْرِهِ – كتاب الدر المختار وحاشية ابن عابدين رد المحتار ج١/ ص١٧٧ دار الفكر
