Question:

I am a man who wears braids to keep his hair neat.  I have heard a hadith in which the prophet ﷺ   permitted a woman to do ghusl without undoing her braids, however, some scholars argue this ruling only applies to women and the only piece of evidence they provide for this is that it was a woman who had asked the question and that men must un braid their hair to perform ghusl. Could you please clarify this for me I find it very confusing.

Answer:

When a woman has her hair braided whilst performing ghusl then it is permissible for her to keep it this way as long as the water reaches the roots of her hair.

The ruling regarding washing braids without undoing the hair is an exception for women because women’s hair is usually longer than a man’s and more difficult to unbraid. 

Only Allah (عز و جل) knows best.

(ولا تنقض ضفيرة أن بل أصلها) أي ولا يجب على المرأة أن تنقض ضفيرتها إن بلا الاغتسال أصل شعرها. والأصل فيه ما رواه مسلم وغيره عن أم سلمة قالت قلت يا رسول الله إني امرأة أشد ضفر رأسي أفأنقضه لغسل الجنابة؟ فقال: لا إنما يكفيك ان تحثي على رأسك ثلاث حثيات ثم تفيضين عليك الماء فتطهرين. 

وذكر القاضي عياض وأورد صاحب المعراج أن حديث أم سلمة معارضة للكتاب وأجاب تارة بالمنع فإن مؤدي الكتاب غسل البدن والشعر ليس منه بل متصل به نظرا الى أصوله فعملنا بمقتضى الاتصال في حق الرجل حتى قلنا يجب النقض على الأتراك والعلويين على الصحيح، ويجب عليها الايصال الي أثناء شعرها إذا كان منقوضا لعدم الحرج وبمقتضى الانفصال في حق النساء دفعا للحرج إذ لا يمكنهن حلقه، وتارة بأنه خص من الآية مواضع الضرورة كداخل  العينين فيخص بالحديث بعده.
