Question
Asalamu Alaikum, whenever I miss for example 2 rakah in the congregation and then join in the congregation. I consider the rakah which I performed with imam as the first two. Is it, right? I need Imam’s opinion as well.

Answer
When you are making up for the missed rakaats, then you should consider it to be the first rakaat in terms of qiraat and the last rakat in terms of tashahhud. Therefore, if he finds one rakat with the imam in maghrib, he will make up for two rakaats by sitting for tashahhud in between, resulting in three tashahhud, one with the imam and two on his own, and in every rakaat he will recite Fatihah and a surah. If he misses qirat in any of the rakats his salaah will be void.
If he finds one rakat with the imam in a salah consisting of four rakats, he will first make up for one rakat with Fatihah and a surah, then he will sit for tashahhud. Thereafter, he will make up for the next rakat with fatihah and surah, and then the third rakat, however in the third rakat he has a choice of reading Fatihah or not to read it, although it is better to read it.
If he misses two rakaats, he will make up for the two rakats with Fatihah and surah. If he misses the qiraat in any rakat, his salah will be void. (Fatawa Hindiyah, vol.1, pg.102)
