Question:  

My husband in an angry argument texted me “I think we should end this” is this a divorce? 

Also in the argument I asked him do u not fear god and he shook his head angrily and I said are u a kaffir and he said yeah. Is our nikkah still valid?

Answer:

For divorce to be valid, the husband must speak in the past or present tense. The phrase ‘I think we should end this’ does not count as a divorce even if the wife replies ‘yes’ because it is a statement expressing a future intention rather than a present decision. 

It is important that we also understand that anger makes people say things they do not truly mean out of frustration. Nevertheless, it is a severe statement to proclaim oneself a kafir, and your husband must repent to Allah, renew his faith, and renew his marriage with you as it has been annulled.

وإن دخلت على الزمان فإن كان ماضيا يقع الطلاق في الحال نحو أن يقول أنت طالق في الأمس أو في العام الماضي لأن إنشاء الطلاق في الزمان الماضي لا يتصور فيجعل إخبارا أو تلغو الإضافة إلى الماضي ويبقى قوله أنت طالق فيقع في الحال وكذلك إذا كان حاضرا بأن قال أنت طالق في هذا الوقت أو في هذه الساعة يقع في الحال وإن كان مستقبلا لا يقع حتى يأتي بأن قال أنت طالق في غد أو في الشهر الآتي لأن الطلاق يحتمل الاختصاص بوقت دون وقت فإذا جعل الغد ظرفا له لا يقع قبله
