Question:
Had a fight with husband. Out of anger, he said, “chal ghar se farig ho”.
After a few minutes we were both normal. In my mind, I kept thinking what if it counts as a divorce? Then I asked him, and he said, I meant to get lost and away.
And even took a qasam and said I had no intention to divorce. So my question is will it be counted as divorce or not?

Answer:
In the above-described situation, divorce has not taken place unless the husband intended “divorce”. If there is no intention of divorce by the husband then the quoted statement does not constitute a divorce. – (See: Rad Al-Muḥtār, Vol 3, Page 296, Dār Al-Fikr1)
“‘Abd Allāh Ibn Yazīd bin Rukānah narrated from his father, from his grandfather (may Allāh be pleased with them) who said, “O Messenger of Allāh! I irrevocably divorced my wife.” So he asked, “What did you intend by that?” I replied, “One (divorce pronouncement).” He then questioned, “[Do you swear] By Allāh?” I stated, “[Yes] By Allāh.” He clarified, “Then it is as you intended.” – (Tirmidhī 1177)2
