Question:

If a grandfather touches his granddaughter with lust, does that affect the nikah of the girl’s parents?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

If the granddaughter was close to buloogh or baaligh already, then the rulings pertaining to Hurmatul Musaaharah will become applicable according to the Hanafi Madhab.

If the granddaughter in question was the perpetrator’s daughter’s daughter, then his wife, i.e., the girl’s maternal grandmother would become unlawful for the grandfather.

If the girl was the grandfather’s son’s daughter, the girl would not be able to marry any of the grandfather’s son’s sons ie. her cousins from the paternal side.

 ما لو انتشر وطلب امرأة فأولج بين فخذي بنتها خطأ لا تحرم أمها ما لم يزدد الانتشار (قوله: وفي امرأة ونحو شيخ إلخ) قال في الفتح: ثم هذا الحد في حق الشاب أما الشيخ والعنين فحدهما تحرك قلبه أو زيادته إن كان متحركا لا مجرد ميلان النفس فإنه يوجد فيمن لا شهوة له أصلا كالشيخ الفاني ثم قال ولم يحدوا الحد المحرم منها أي من المرأة وأقله تحرك القلب على وجه يشوش الخاطر

قال العلامة ابن عابدين رحمه  قوله (أو يدها ابنه )الله  أي المراهق كما علم مما مر وأما تقييد الفتح بكونه ابنه من غيرها فقال في النهر ليعلم ما إذا كان ابنه منها بالأولى ولا بد من التقييد بالشهوة أو ازديادها في الموضعين (رد رد المختار ص٣٥/٣
