Question
If one was to take an oath on the Quran/Mushaf, will he be committing Shirk?
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
Sayyiduna Abdullah Ibn Umar ( رضى الله عنهما ) narrates that the Messenger (صلى الله عليه وسلم) of Allah (عز و جل) said:
ألاَ، إنَّ اللَّهَ يَنْهاكُمْ أنْ تَحْلِفُوا بِآبائِكُمْ، فَمَن كانَ حالِفًا فَلْيَحْلِفْ بِاللَّهِ، وإلّا فَلْيَصْمُتْ
“Verily! Allah forbids you to swear by your fathers. If one has to take an oath, he should swear by Allah or otherwise keep quiet”.[1]
Also, Sayyiduna Abdullah Ibn Umar ( رضى الله عنهما ) narrates that the Messenger (صلى الله عليه وسلم)of Allah (سبحانه و تعالى) said:
مَن كانَ حالِفًا فَلا يَحْلِفْ إلّا بِاللهِ
“He who takes an oath, must not take an oath but by Allah”.[2]
It is no secret that swearing by the Quran is now customary, so it is an oath.[3]
A person should not swear by other than Allah (عز و جل), like the Prophet, the Quran and the Kaaba.
Kamal(رحمه الله) said:
ولا يَخْفى أنَّ الحَلِفَ بِالقُرْآنِ الآنَ مُتَعارَفٌ فَيَكُونُ يَمِينًاوأمّا الحَلِفُ بِكَلامِ اللَّهِفَيَدُورُ مَعَ العُرْفِ
It is no secret that swearing by the Quran is now common, so they become familiar. And as for swearing by the word of Allah,it revolves with the custom. [4]
Al-Aynee(رحمه الله)said: وعِنْدِي أنَّ المُصْحَفَ يَمِينٌ لا سِيَّما فِي زَمانِنا
I believe that the Mushaf is an oath, especially in our time. [5]
