Question:

 

I am an amazon affiliate marketer. I am promoting amazon health and fitness equipment like treadmills, exercise bikes etc. I have to use an image of this product in which most of the photos involve women without hijab. Although I am trying to avoid this type of photo and put only links if anyone clicks the link photos of women without hijab may come automatically. Will I be responsible for that as a Muslim?

Answer:

 

No, you will not be held responsible for it Inshaa’Allah.

 

When an individual is the cause of another doing Haram, then we consider whether he was transgressing in what he was doing. If he was not transgressing (i.e., if his actions were permissible), then he would not be held responsible (Qawaaid Fiqhiyyah, Pg 103-104).

 

In your case, you are promoting Halal products in a Halal manner. And you are taking measures to avoid Haram. Therefore, as your actions are Halal, you will not be held responsible if anyone clicks on an affiliate link and sees images of women without Hijab. You should continue to avoid inserting such images and check the landing page of the links to see whether such images appear. If they do, and you can avoid it, you should avoid using that link.

 

 

المتسبب لا يضمن إلا بالتعمد أما المتسبب فهو الذي يكون فعلي مفضيا إلي الحكم دون مباشرة اليه فهذه ينظر في أمره : فإما أن يكون في تسببه متعديًا أو لا و إما أن يكون في تسببه غير معتد ، مثل أن : يحفر بئرا أو حفرة في أرضه فيدخل حيوان لجاره و يسقط فيها ، أو يحفر حفرة في الطريق العام بإذن ولي الأمر و يحوطها بحاجز ، فيسقط فيها أعمي أو حيوان فلا ضمان عليه لكونه غير معتدا في تسببه
