Question:
I went swimming and when I went to change I saw that my penis opening had kind of unfolded to the side and also am not sure if it was shampoo or discharge in the opening of the peehole. I got changed and left after seeing this.
Were my swimming shorts impure and my legs and feet impure cause I put my shoes on and also walked around my house as I thought only my private part area was impure but I now realised when I was swimming the najasah must’ve went all over my shorts as water spread it onto my shorts. I also showered with the shorts in at the swimming area before changing. Should I now wash my shoes and what about my carpet my feet touched?.
In the name of Allah, the Most Gracious, the Most Merciful
Answer:
If your default position was that you were clean from all impurity, and then you have doubts about whether you are impure, you should maintain the assumption of purity.
This aligns with the legal maxim, “Certainty is not lifted by a doubt” (Qawaid Al Fiqhiyyah, p. 15).
This means that your doubt about impurity does not change your initial condition of being in a pure state, so you will be considered pure.
Another legal maxim supports this: “There is no consideration for mere suspicion,” meaning that legal verdicts cannot be based on highly unlikely possibilities (Qawaid Al Fiqhiyyah, p. 25).
