In a Khula Case Would the Wife Need To Pay Back the Value of Gold Written on the Nikah or the Value Now?

Question:

 

My mother recently requested a khula from my father, who has requested the mahr back. The mahr at the time of nikkah was gold but stated on the nikkah gold at the value of. My mother no longer has this gold, but would she need to pay back the value written on the Nikkah or the gold value now? Thank you.

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

Khula is like a business transaction. Both parties must agree to an amount of wealth given to the husband by the wife in lieu of Talaq. (1)

 

The Khula is complete after the husband terminates the marriage by giving Talaq (divorce). (1)

 

According to the scenario mentioned above, the Khula amount will be at the value of what the husband had paid for Mahr. (2)

 

However, it will be better for the couple to communicate and get clarification from the husband so that there are no further altercations.
