Question:
My query is regarding individuals performing Hajj illegally. Some people are well off, they have several freehold houses and have performed Hajj multiple times. In spite of this, they are doing Hajj illegally, breaking the Saudi Arabian law and encouraging others to do so. It is unfair to people who have saved up many years to perform Hajj. When asked, they justify their performance of Hajj illegally through fatwas, specifically a situation regarding a man in Dubai who could not afford to perform Hajj. These individuals use various fatwas to say their Hajj is accepted. A lot of people in the local community are being encouraged to do Hajj illegally, even the Imam of our local masjid is actively condoning it. What is the ruling regarding this?

Answer:
Of course, one must follow the relevant laws when performing Hajj and one should not perform Hajj illegally. The Saudi authorities restrict the number/quota of Pilgrims so that Hajj does not become overcrowded and unsafe; and so following their laws and regulations ensures that everybody has a safe Hajj.
Imams should not be encouraging breaking the law, thus misguiding the community. Such Imams should be reprimanded by senior ulema.
However, if a person was to do Hajj illegally and fulfil all the Arkan (obligatory acts of Hajj i.e. standing at Arafah and Tawaf Ziyarah), the Hajj would be complete and the obligation of Hajj would be fulfilled. But they would be very sinful for disobeying the Hajj laws and regulations, thereby contributing to overcrowding and a potential lack of safety caused by overpopulating Makkah above and beyond what the Saudi authorities can accommodate for. Such a person would be deprived of the full blessings and reward of Hajj due to their blatant disregard for the law.
Furthermore, if this is not their first Hajj, then they are even more foolish for going to such extremes just to break the law and perform a Nafl Hajj. They are committing sin in order to perform an optional ibadah. Such people have a very incorrect understanding of Deen. According to the teachings of Rasulullah (SAW), if you abstain from haram, you will be counted among the Greatest worshipers. [Sunan Tirmidhi (Hadith: 2305) and Musnad Ahmad, vol.2 pg.310]. And avoiding even minor sins is more important than performing a significant optional deed like Hajj.
Furthermore, some countries (like Indonesia) have a waiting list for Hajj. It is unfair for a person to skip the line while others are patiently waiting for their turn to perform Hajj.

حَدَّثَنَا عُبَيْدُ بْنُ أَسْبَاطِ بْنِ مُحَمَّدٍ الْقُرَشِيُّ، حَدَّثَنِي أَبِي، عَنْ هِشَامِ بْنِ سَعْدٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ أَبِي صَالِحٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم “ الْمُسْلِمُ أَخُو الْمُسْلِمِ لاَ يَخُونُهُ وَلاَ يَكْذِبُهُ وَلاَ يَخْذُلُهُ كُلُّ الْمُسْلِمِ عَلَى الْمُسْلِمِ حَرَامٌ عِرْضُهُ وَمَالُهُ وَدَمُهُ التَّقْوَى هَا هُنَا بِحَسْبِ امْرِئٍ مِنَ الشَّرِّ أَنْ يَحْتَقِرَ أَخَاهُ الْمُسْلِمَ ” . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ . وَفِي الْبَابِ عَنْ عَلِيٍّ وَأَبِي أَيُّوبَ .
Abu Hurairah narrated that the Messenger of Allah said: : “The Muslim is the brother to the Muslim, he does not cheat him, lie to him, nor deceive him. All of the Muslim is unlawful to another Muslim: His Honor, his wealth, and his blood. At-taqwa is here. It is enough evil for a man that he belittle his brother Muslim.”
