Question:

 

Does Induced Lactose breastfeeding cause a mahram relationship between the wife’s husband and (adopted/foster) child as the milk was not from the husband?

 

 

 

 

In the name of Allah, the Most Gracious, the Most Merciful

 

Answer:

 

A husband only becomes a milk-father when his wife’s lactation is due to having a child from him. Therefore, in the case of induced lactation when the husband and wife have not had a child together, then he will not become the child’s milk-father. The only milk-relation which is established in this case is the wife becoming the child’s milk-mother.

بيان لأن لبن الفحل يتعلق به التحريم لعموم الحديث المشهور وإذا ثبت كونه أبا له لا يحل لكل منهما موطوءة الآخر، والمراد به اللبن الذي نزل من المرأة بسبب ولادتها من رجل زوج أو سيد فليس الزوج قيدا في كلامه

وقيدنا بكونه نزل بسبب ولادتها منه لأنه لو تزوج امرأة ولم تلد منه قط ونزل لها لبن وأرضعت به ولدا لا يكون الزوج أبا للولد لأنه ليس ابنه لأن نسبته إليه بسبب الولادة منه فإذا انتفت انتفت النسبة فكان كلبن البكر ولهذا لو ولدت للزوج فنزل لها لبن فأرضعت به ثم جف لبنها ثم در فأرضعت صبية فإن لابن زوج المرضعة التزوج بهذه الصبية ولو كان صبيا كان له التزوج بأولاد هذا الرجل من غير المرضعة كذا في الخانية

رجل تزوج امرأة ولم تلد منه قط ثم نزل لها لبن فأرضعت صبيا كان الرضاع من المرأة دون زوجها حتى لا يحرم على الصبي أولاد هذا الرجل من غير هذه المرأة
