Question

I have read Fatwa ID: 01584 regarding Talaq Marsumah and Ghair Marsumah and Alhamdulillah I understand the masala.

My question is what is the hukm if the letter/email/text which addresses the wife directly but is not sent, is not written by the husband but by some third person?

So the husband instructed someone to write a letter of divorce but due to it not being sent the ruling of Ghair Masurmah would apply, which would then depend on the intention of the husband. But is this still the case when the one writing the letter is not the husband?

Regarding your question yes, it will still be valid even if the one writing the divorce is not the husband because he instructed and appointed a third person (Wakeel) to write it for him. The question here is would the Talaq occur…well that depends on the written statement and if it’s still unclear then it will depend on the husband intention.
