Islamic Ruling on Accepting Investment from an Individual Dealing with Riba

Question:

Assalamu Alaikum wa Rahmatullahi wa Barakatuh,

I hope you are doing well. I would like to seek your guidance regarding a situation I am facing in my business plans. I recently pitched my business idea to an investor, and he has shown interest in investing. However, I believe that he currently has a loan account with a conventional bank. He deals with the bank, pays interest, and his financial dealings involve riba (interest).

If I proceed to accept his investment, knowing that his finances are tied to such transactions, would this be permissible in Islam? I wish to ensure that my business dealings and income remain halal and free from any association with haram practices.

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

If your transaction with this individual is conducted in a manner that is free of any impermissible elements, it is permissible for you to accept his investment. In Islamic jurisprudence, the source of the investor’s wealth does not affect the permissibility of your earnings, as long as you acquire the funds through a halal and permissible transaction. Thus, it is permissible to do business with a non-Muslim, as long as the transaction itself doesn’t have any problematic elements that go against the Shariah.

قَالَ: وَأَهْلُ الذِّمَّةِ فِي حُكْمِ الْهِبَةِ بِمَنْزِلَةِ الْمُسْلِمِينَ؛ لِأَنَّهُمْ الْتَزَمُوا أَحْكَامَ الْإِسْلَامِ فِيمَا يَرْجِعُ إلَى الْمُعَامَلَاتِ، إلَّا أَنَّهُ لَا يَجُوزُ الْمُعَاوَضَةُ بِالْخَمْرِ عَنْ الْهِبَةِ فِيمَا بَيْنَ الْمُسْلِمِ، وَالذِّمِّيِّ، سَوَاءٌ كَانَ الْمُسْلِمُ هُوَ الْمُعَوِّضُ لِلْخَمْرِ أَوْ الذِّمِّيّ
