Madhi Leaking Out of the Private Parts the The Whole Day After Relations

Question:

 

After sleeping with my wife, in the morning I had ghusl and ensured there were no impurities, But during work, I realised before praying zohr my trousers became soiled with madhee and my privates still had madhee flowing out as a result I washed my privates and trousers and waited for a while, I then unfortunately missed the Jamat.

 

Then closer to asr time or before asr time like 30 minutes, I was still leaking and even whilst making wudu was still leaking and the madhee still flowed onto my trousers. So I made wudu and checked my privates, I could still see madhee, I then performed salah. do I still need to repeat the salah, as I had no control over the madhee flowing out. Also, what is the appropriate way of addressing these problems, it happens once in a while and I don’t want to end up making qadha.

Answer: 

 

The condition that is described above, in your question, fits the definition of a ma‘dhūr (excused person). An excused person (ma‘dhūr) with respect to the laws of purification is one who experiences the continuous exiting of ritual impurity from the body, such as a continuous nose bleed, dripping of urine continuously in such a way that it remains for the period of one complete salāt time and one does not find enough time wherein he/she can perform wudū’ and can pray the fard of the salāt. 

 

 

So there is no need to repeat the salāh that was performed in the said state, unless the impurity on the trouser is equal to the amount of a dirham and there was enough time to wash the impurity off and pray the Salāh, without the trouser getting dirty again.

 

 

If an excused (ma‘dhūr) person’s clothing has some physical impurity on it and the impurity is equal to the amount of a dirham and it is not possible to wash it because of the clothing becoming impure again, then it will not be necessary to wash it before praying the salāt. However, if he thinks that it is possible to wash it and perform the salāt without the impurity getting on the clothing again, then it will be necessary to remove the impurity otherwise the salāt will not be valid.

«وَإِنْ سَالَ عَلَى ثَوْبِهِ) فَوْقَ الدِّرْهَمِ (جَازَ لَهُ أَنْ لَا يَغْسِلَهُ إنْ كَانَ لَوْ غَسَلَهُ تَنَجَّسَ قَبْلَ الْفَرَاغِ مِنْهَا) أَيْ: الصَّلَاةِ (وَإِلَّا) يَتَنَجَّسْ قَبْلَ فَرَاغِهِ (فَلَا) يَجُوزُ تَرْكُ غَسْلِهِ، هُوَ الْمُخْتَارُ لِلْفَتْوَى وَكَذَا مَرِيضٌ لَا يَبْسُطُ ثَوْبَهُ إلَّا تَنَجَّسَ فَوْرًا لَهُ تَرْكُهُ »

(قَوْلُهُ: هُوَ الْمُخْتَارُ لِلْفَتْوَى) وَقِيلَ لَا يَجِبُ غَسْلُهُ أَصْلًا، وَقِيلَ: إنْ كَانَ مُقَيَّدًا بِأَنْ لَا يُصِيبَهُ مَرَّةً أُخْرَى يَجِبُ. وَإِنْ كَانَ يُصِيبُهُ الْمَرَّةَ بَعْدَ الْأُخْرَى فَلَا وَاخْتَارَهُ السَّرَخْسِيُّ بَحْرٌ.

«(وَصَاحِبُ عُذْرٍ مَنْ بِهِ سَلَسٌ) بَوْلٍ لَا يُمْكِنُهُ إمْسَاكُهُ (أَوْ اسْتِطْلَاقُ بَطْنٍ أَوْ انْفِلَاتُ رِيحٍ أَوْ اسْتِحَاضَةٌ) أَوْ بِعَيْنِهِ رَمَدٌ أَوْ عَمَشٌ أَوْ غَرَبٌ، وَكَذَا كُلُّ مَا يَخْرُجُ بِوَجَعٍ وَلَوْ مِنْ أُذُنٍ وَثَدْيٍ وَسُرَّةٍ (إنْ اسْتَوْعَبَ عُذْرُهُ تَمَامَ وَقْتِ صَلَاةٍ مَفْرُوضَةٍ)

بِأَنْ لَا يَجِدَ فِي جَمِيعِ وَقْتِهَا زَمَنًا يَتَوَضَّأُ وَيُصَلِّي فِيهِ خَالِيًا عَنْ الْحَدَثِ (وَلَوْ حُكْمًا) لِأَنَّ الِانْقِطَاعَ الْيَسِيرَ مُلْحَقٌ بِالْعَدَمِ (وَهَذَا شَرْطُ) الْعُذْرِ (فِي حَقِّ الِابْتِدَاءِ، وَفِي) حَقِّ (الْبَقَاءِ كَفَى وُجُودُهُ فِي جُزْءٍ مِنْ الْوَقْتِ) وَلَوْ مَرَّةً (وَفِي) حَقِّ الزَّوَالِ يُشْتَرَطُ (اسْتِيعَابُ الِانْقِطَاعِ) تَمَامَ الْوَقْتِ (حَقِيقَةً) لِأَنَّهُ الِانْقِطَاعُ الْكَامِلُ»
