Question
Two neighbours perform Eid salah in one congregation with two neighbours but there is a road in between and both are in their own garden. Is there any tahqeeq on this?
Would the following apply?
والفاصل في مصلى العيد لا يمنع وان كثر
It probably would not apply as Musalla is like Masjid. Has anyone looked into this?

Answer:
For the validity of a congregational prayer, there must not be a difference in location (اختلاف المكان). If a difference in location (اختلاف المكان) is found, then the congregation will not be valid.[1]
Furthermore, if there is a road separating the congregation then there two scenarios:
- That the rows of the congregation are continuous with people praying on the road. In this scenario, there is no difference in location (اختلاف المكان) and the congregation is valid.
- That the rows of the congregation are not continuous with a separation due to the road. In this scenario, there is a difference in location (اختلاف المكان) and the congregation will not be valid.[2]
Therefore, due to the road, there is a difference in the two neighbour’s location (اختلاف المكان) and their congregation will not be valid.
Additionally, the quotation (والفاصل في مصلى العيد لا يمنع وان كثر) i.e. “and the separation within the prayer area for Eid will not invalidate despite it exceeding (the length of two rows)” has been mentioned in Raddul-Muhtar[3]. The topic however of the discussion is related to the praying area of a large masjid.
